TRADEMARK REGULATIONS
Applicable subjects:
- Sellers who have a store in the SenPrints system.
- Sellers who use SenPrints payment gateway.
Regulations on selling products with Trademark (DMCA):
- Sellers are not allowed to sell designs that violate the Trademark (TM) of big brands such as Gucci, LV, Adidas, Nike, ... which are major fashion brands.
- Sellers are not allowed to sell designs that violate the TM of sports teams in tournaments such as NFL, FIFA, C1, ... by using logos, faces, signatures, ...
- Similarly, selling TMs related to music bands or singers by using faces, signatures, logos, band names, ... is prohibited.
- Other similar TMs are also restricted.

- Sellers are fully responsible for any risks and damages caused if there are complaints from the trademark owner.
DMCA violation handling process at SenPrints
After the Seller Support (SS) team confirms that a Seller account violates the DMCA policy, SenPrints will flag the account. The SS team will contact the Seller on various communication channels and send a warning email once to the Seller.
Within 24 hours from the email notification to the Seller, the SS team will recheck the Seller's account to verify that:
- The Seller deleted all DMCA violating campaigns within 24 hours of receiving the email notification, then contacted the SS team to remove the flagged account and committed not to violate the TM selling regulations.
- If the violating campaigns are not removed, the SS team will notify the Seller and block the account.
- In case the Seller's account continues to violate the trademark of any brand even after the flagged account has been removed, SenPrints will block the Seller's account.
Regulations for blocked accounts
In the case of a blocked account, the Seller needs to contact the SS team to verify their personal information (KYC) and sign a commitment to reopen the account. After the account is reopened, except for the amount held for 2 months, the Seller can still sell and withdraw profits as usual.
Example: A Seller violates DMCA, and the account is blocked from April 1st, and the account has a balance of $1,000:
- The entire amount of $1,000 in the account will be held for 2 months.
- Within 2 months from April 1st to May 31st, the Seller can still sell, and if there is any profit, they can withdraw it all.
- After 2 months from June 1st, the amount held due to DMCA violation will be gradually released according to the Seller's profit ratio until the entire amount held is returned. For example, if the Seller has a profit of $100, they will receive $100 in profit + $100 held money being released. (In the above example, the Seller will receive the entire amount held when there is enough new profit of $1,000).
* Note:
- SenPrints will block accounts permanently for severe DMCA violations & TM/DMCA violations that directly affect the SenPrints server without notifying the Seller.
- Intentional severe DMCA violations or mass violations will result in permanent blocking.
- If a violating campaign is sued, SenPrints will lock the account and not pay out the balance. This balance will be used to compensate the plaintiff according to the law.
- For infringed orders that have not been produced, SenPrints will refund them.
